What Is Domestic Violence Under Maryland Law?
Under Maryland law, domestic violence includes physical abuse, sexual abuse, and certain other acts committed by a household member or certain family members. Household members can include current or former spouses, people who have a child together, people who live or have lived together, and people in a current or former intimate relationship.
Domestic violence can take many forms, including:
- Physical assault or threats of physical harm
- Sexual assault or coercion
- Stalking or harassment
- False imprisonment
- Revenge pornography or visual surveillance
Protective Orders in Maryland
Maryland offers several types of orders to protect victims of domestic violence:
- Interim Protective Order: A judicial officer or commissioner can issue an interim protective order at any time of day or night, without notice to the alleged abuser. This order can go into effect immediately.
- Temporary Protective Order: A judge issues a temporary protective order after a hearing at which only you need to appear. It is effective for up to seven days, until a final protective order hearing can be scheduled.
- Final Protective Order: After a hearing at which both parties can be heard, a judge may issue a final protective order that lasts up to one year, or up to two years in certain circumstances.
A protective order can require the abuser to vacate the family home, stay away from your home, workplace, and school, and have no contact with you or your children. It can also grant you temporary custody of your children, as well as emergency family maintenance.
Domestic Violence in Divorce and Custody Cases
Domestic violence is relevant in both divorce and custody proceedings. Maryland courts consider evidence of domestic violence when deciding issues of custody and visitation, and a history of abuse can affect the outcome of your case significantly. Our attorneys have experience presenting evidence of domestic violence in court and advocating for safety measures that protect you and your children throughout the legal process.
If you are the respondent in a protective order proceeding, it is equally important to have experienced legal counsel. A protective order can affect your custody rights, your housing, and your reputation. We represent respondents as well as petitioners in protective order matters.
